The San Diego City Attorney's Office said Tuesday it has declined prosecution. "There was not enough evidence to support a good faith belief that we would have been able to convict beyond a reasonable doubt," said Gina Coburn, spokeswoman for the city attorney. A security guard at the Ivy Hotel said Phillips hit him in the face, according to San Diego police. The guard placed him under citizen's arrest, and police cited him for misdemeanor battery. It was the third time Phillips, 28, has had a run-in with the law downtown since 2006. Each time he has been cleared afterward for lack of evidence.
