Shawne Merriman's Statement Regarding His Arrest

via SDUT (HT: TJB)

On September 6, 2009 the San Diego Sheriffs Department responded to a citizens complaint that was initiated by Tila Nguyen (aka Tila Tequila). I was taken into custody based upon that complaint. At the time, I was concerned about her welfare given the intoxicated state she appeared to be in and I encouraged her to stay until safe transportation could be provided. We would all do our best to help a friend if we considered their actions to be detrimental to their personal safety. I in no way caused any harm to Ms Nguyen, however, paramedics were called and she was examined but no injuries were reported. She was released and has since returned to Los Angeles, California. There have been no charges filed against me. I want to thank the San Diego Sheriffs Department for their professionalism. I will continue to cooperate fully with the Department and I look forward to clearing my name regarding these false allegations. I want to put this behind me so I can continue to focus on a successful season for the San Diego Chargers.

Sounds like a rational explanation.

I just want to say to everyone that jumped the gun to assassinate his character,that formulating a guilty verdict without hearing both sides of the story is wrong.Like I said in the other post,he’s not out of the woods yet but I’m sure glad to hear a statement on his end.Lets wait and see what transpires and keep our fingers crossed that it was all a misunderstanding.Lets get focused on the season ahead of us and root on our team till they reach a Super Bowl and win it for us,the city,and the Charger organization.

I’ve gone from total disarray this morning when I heard the news on a radio update to cautiously optimistic that this will all workout now that more info has come out.

Its still a bad situation, hopefully this will scare everyone on the team straight and we’ll march straight to the Superbowl.

I went through the same thing. Honestly, I believe him more since he’s not denying putting his hands on her. He’s basically saying “I was trying to keep her from driving drunk, but I definitely didn’t hurt her or choke her.”

I’m a lot better with that explanation than if he would’ve came out and said “Nothing happened! I swear!”

Gordi, I think since he says that no chargers have been filed against him he IS out of the woods. I mean, obviously he’ll face media scrutiny and the NFL may look into the case, but he won’t be going to court. Also, in a league (and on a team) that has problems with DUIs, stopping someone from driving drunk should be praised.

I think there is still plenty of time for either civil or crimal charges to be filed

It is basically a "he said -she said" situation, but there seem to be witnesses. Not sure how it all plays out, but I wouldn’t say Merriman is out of the woods this soon.

This whole "looks drunk… acts drunk… yet claims she doesn’t drink" is a weird situation. If she was drunk technically her signature on the citizen’s arrest warrant is invalid. Perhaps that is why she’s claiming not to have had any alcohol. Obviously once she sobered up she could then sign a second warrant, but her impairment at the time of the incident would raise questions about her memory of the events. So maybe she’s lying about the drinking in an attempt to preserve her credibility regarding the arrest warrant.

On the flip side she had Merriman arrested and later Merriman is found not guilty of the criminal charges, he could file a counter suit for false imprisonment and defamation against her. If I was Merriman I would do this even if I couldn’t collect a dime from her, if for nothing else than to set the record straight and clear my good name. She’s responsible for her actions (the decision to have him arrested) regardless of her state (intoxicated or not).

Jumping to Conclusion

When I first heard about this story, my first thought was to find out as much as possible before voicing an opinion. After I read all of the recent news accounts, I have determined that Shawne should be given the opportunity to defend himself. These things tend to be over blown and in the end, Truth will be told. I would hope that the the Media and NFL will treat this like Ben’s situation rather than the way Kobe was treated by the media and the NBA. Most men have been in Shawne’s situation. I know I have. Crazy things happen when the night is late and someone wants to drive home drunk or unable to reason. This brings arguments and misunderstanding. I was not there so I don’t really know. I would hope everyone else would just wait and see. These are serious charges. I hope Shawne the best. To Tequilla, Just be truthful.

AND if he’s telling the truth, he should actually come out of this story with people having a higher regard for his character (making sure a friend of his doesn’t put themselves or someone else at risk of death or injury) than they had before.

That should happen, but it won’t. The same people that were saying “roid rage” yesterday will add this into their mix.

On a side note, I’ve done the exact same thing Shawne has done. More than once, actually. It just always happened to be another guy that I was fighting for his keys. Those friends always thanked me the next morning. If Tila has any sense, and Shawne is telling the truth, she owes him an apology and a “thank you”.

Do you have proof that he wasn’t telling the truth about the steroids? The tests don’t definitively say that a person was on steroids, they just come up “tainted” with a particular chemical. In Shawne’s case, he got all of his supplements tested and one of them came up with having the chemical he tested positive for in it, even though it doesn’t say so on the label.

Now….unless you are Shawne Merriman or are a person who sold steroids to Shawne Merriman, you have no more idea than anybody else whether or not that’s the truth.

I don’t think they will be. But, the D.A.’s office said yesterday that they would review the sherrifs report, interviews etc. and then decide IF charges should be filed. I was concerned yesterday when I saw the story, but after reading the story I figured he was probably innocent of the allegations.

I think he’s in the clear. If the DA decided to go in a different direction from the Sheriff in a high-profile case like this, it would be a sh*t-storm.

Also, the cops aren’t real quick to let a guy of Shawne’s size walk away cleanly after being accused of abuse by a woman Tila’s size. If they have already said they’re not filing charges, I imagine that means that found nothing to back up her claim.

Let's stand behind our guys

When people get pulled over for DUI, there isn’t much to argue about. But this one seems different. Let’s not forget that Merriman is very active in the community (helping rebuild fire damaged homes, donating over $100,000 to keep the downton homeless shelter open a few years ago, etc.) I hope he isn’t guilty, and I hope we can trust him about this. Maybe Shawne should think about who he hangs out with. I hadn’t heard of this chick before this, but she souds like someone who nothings good comes of. By the way, when will the chargers learn nothing good happens after 2am? Just ask Steve Foley, V-Jack, Shaun Philips, to name a few.

i actually think that

al davis is the “drunken silicone skank” here…In my opinion, she could probably run the Raiders better than Al has, wouldnt take much to do so.

Honestly, Shawne merriman may use riods and be a complete tool; but maybe not? We all know tila tequila is the worst woman ever. She is famous because of myspace. Seriously. Myspace. Bleh this is the problem with our open court system

These things should no be made public until charges are filed from the DA. Its to easy for people to use athletes/famous people to get their name in the papers or even worse black mail them to try and get them to settle things out of court just to keep their names out of the paper. We have laws to protect victims names from becoming public shouldn’t we also have the same thing for the people who are being accused but are not yet found guilty?

i was sick to my stomach yesterday...

when i heard the initial news reports i was shocked, with the season starting this week this is one of the last things merriman or the team needs…from everything i’ve seen today the situation looks a lot better…the fact that the Sheriff’s Dept. isn’t filing charges is good, but it doesn’t mean it won’t happen…i’m not sure if this applies in CA, but most states will automatically pick up and file DV charges even without “victim’s” consent…in a case this high profile i would hope they would ascertain all the facts before filing charges instead of the other way around…believe me, that does happen, but generally to people with less resources than Shawne

on another note…i saw Kevin Acee on sportscenter just a little while ago and he was talking about how A.J. Smith keeps files on all his player’s extracurricular activities and Shawne’s is supposedly very thick and A.J. apparently doesn’t like that….is this about his businesses and celebrity appearances? from everything i’ve heard and seen, Shawne is extremely active with the community and charities and it seems odd that those sort of things would be upsetting to management….maybe A.J. needs to concentrate on keeping good talent in San Diego and figure out how to keep the team here for years to come

I believe in cases where the police pick up and file a DV case without the victim’s consent, it’s done because there’s obvious proof (like a black eye on the woman). In this case, the police didn’t even see enough proof to arrest Merriman on their own and instead made Tila take responsibility for the arrest.

Yes, Acee talks all the time about A.J. Smith’s dislike with Merriman’s businesses and celebrity appearances. I don’t know that I feel the same was as the Chargers GM, but my opinion and the opinion of the fans matters very little. As long as the guy keeps finding talent and building championship contending teams, he’ll have a job in SD.

maybe i’m still a little biased over the way junior seau and rodney harrison were handled, it just hasn’t alway seemed that the moves made were in the best interests of the team…maybe some of that is fan loyalty and i know you can’t factor that into a business decision, but AJ does leave me scratching my head sometimes…like the public comments he made concerning LT before his deal was restructured…i will agree that for the last several years he’s done a great job assembling talent in San Diego and has had a nice mix of veterans around for leadership….so who am i supposed to direct my frustrations toward(s)?…norv?…can anything be traced back to bobby?

Does anyone remember the Duke case?

I’m getting sick and tired of the media trying to be first with a story and reporting it incorrectly, thus breeding the stupid comments from lame Patriots & Raiders fans, among others. I’ll always remember the Duke case where the media had these guys fried on a skillet and ready to serve prison time, and it was the girls who made up the story. These gold-digger women are all about getting fame and money for themselves so to take their side automatically is ridiculous.

The Raiders fans need all the help they can get so they were excited to hopefully subtract Merriman from our roster to give them a 1% chance of winning vice only 0%. What a bonehead move by Al Davis – let’s trade a potential top 10 pick in 2011 for an aging defensive tackle.

The Patriots fans love to bring up the steroids charge whenever the Chargers & Merriman are discussed, nevermind their entire organization was caught cheating. There’s few things more pathetic than a hypocrite.

It certainly looks much better than it did initially. Several things back his story, deputies thought she was tanked but weren’t sure about him. There were no obvious injuries to her. Despite being ‘detained’ against her will she was able to get a phone and call the police.

For all that, it seems like a 270 pound professional athlete ought to be able to get keys from a five foot woman without that much fuss. From the sound he was probably tired and maybe hung over and she was swacked and unreasonable. This is hardly going to do much for his leadership position on the team and no matter what Cooper says, this is a distraction. I think AJ is right, Merriman’s life style and varied interests make him far less valuable. I was really hoping he would have a great year and get re-signed, but now I think the Chargers are better off letting him go, either through trade or FA.
