Tila Tequila is Suing Shawne Merriman

As expected, the woman whom Chargers linebacker Shawne Merriman allegedly battered and falsely imprisoned has filed suit as a result of an incident occurring in early September.

Per TMZ.com, Tila Tequila Nguyen claims that Merriman has a bad temper and a drug problem, that he grabbed her, "shook her like a rag doll," choked her, and threw her down. She also claims that Merriman "humiliated" her because of the fact that she's bisexual.

I'm not taking this seriously. Considering the police decided not to press charges, I think Tila's legal team is going to have a hard time getting a verdict in their favor.

However, I doubt that's the point. This seems like a PR move (good for her, bad for him). It's just another way for Tila to keep her name in the papers.

she’ll have an easier time than the police/DA, because the burden of proof is lower in civil cases than criminal ones. So we’ll have to wait and see where this goes.

Civil burden = preponderance of the evidence

Tila Tequila = no evidence

It’s kind of hard to prove something that didn’t happen.

If we take what seems to be the most likely scenario, even he admits he restrained her. The fact that she was nekkid, drunk and running off into the dark makes it a tough call on what he ought to have done.

It’s hard to see her getting any cash from Merriman on this; it does seem like she will reap a lot of ink/pixels which is her real stock & trade.

this is a correct statement.

most likely it will settle b/c civil trials can be long and drawn out. and the last thing merriman wants is a civil lawsuit which will take time away from practice. just pay the b*tch and move on.

The two will probibly settle out of court....

& Tila will get a large sum of $$$…
… & Tila’s 15 minutes gets extended because see will use that $$$ to pay for more publicity….

You're right

She probably wouldn’t win if they litigate to the end but if he settles quick and early she’ll get the least amount of exposure which is probably the best idea. Although it would be sort of admitted “guilt” but whatever, something tells me Shawne Merriman doesn’t care what people think.

What a strange coincidence

As soon as Lights is regaining some national spotlight; out of the woodwork comes Tila. If this move were anymore calculated; NASA would be involved….

…OOOH!! I just got an idea!!! If (or should I say when) Tila loses this case; she should be volunteered to be on the next probe NASA sends to the moon to check for water. At least then she’d be somewhat useful…..

This is why...

We need to have some penalty in place for frivolous lawsuits. It’s idea’s like this that make our legal system a joke. " Hey, I’m going to sue this rich and famous guy cause he’ll just want it to go away fast and give me some money to do that! " Give me a break, frivolous lawsuits make me sick.
